Definitions and Interpretation/Glossary of Terms

“Agreement” means these terms of usage, and includes any and all annexures, schedules and appendices to these terms of usage. For the sake of further clarity, it
includes the Promotion Terms and Conditions.

“Entrant” means any natural person aged 18 years or older, who is a legal resident of the Republic of Zambia, and who enters the Promotion in accordance with these Terms & Conditions.

“Participation” means the act of any Entrant who complies in full, with the eligibility criteria set out in this Agreement for participation in the Promotion.

“Pernod Ricard Group” means any and all holding companies and subsidiaries of Pernod Ricard and associated entities and shall include Inverroche.

“Prize” means the prize awarded to the Winners as set out and detailed in the Promotion Terms and Conditions.

“Promotion” means the Jameson Festive In-Store Promotion, which awards guaranteed prizes upon the purchase of participating Jameson Black Barrel bottles.

“Territory” means the Republic of Zambia.

“Winner” shall mean a qualified entrant who has successfully been awarded the Prize in terms of the Promotion by the duly authorized party on the date of announcement, unless provided otherwise for, by the relevant party authorized to issue such prize.

Section 1 – General Terms and Conditions

1. The Promoter reserves the right, in its sole discretion and to the extent permitted by law, to amend the Promotion Terms and Conditions at any time and publish same on its social media platforms. The Promoter may opt to notify the Entrant of any changes, however there is no obligation on the Promoter to do so, and it remains the Entrant’s responsibility to check these Promotion Terms and Conditions regularly.

2. This Promotion supports responsible drinking. Alcohol is not for sale to persons under the age of 18. Drink responsibly.

3. The Promoter reserves the right to terminate the Promotion at any time and without notice for any reason beyond its control that is not caused by the Promoter’s fault and could not reasonably have been foreseen. Such reasons include, but are not limited to, any act of God, civil disturbance,
power failures or reduction in power supply, acts, orders or regulations of any governmental or regulatory authority, agency or department, or any compromise of the Promotion or its associated digital entry mechanisms, as well as any similar events beyond the Promoter’s control.

4. In the event of such termination, we do hereby record that any accrued right that has become vested in the Entrant shall continue to remain vested, however and in the event that no right or entitlement has become vested, the Entrant agrees to the waiver of such right or entitlement and acknowledges that the Entrant will have no right of recourse against the Promoter, its agents
and/or staff.

5. In the event of a dispute, the decision of the Promoter will be final and binding and no correspondence will be entered into. In this regard and for further clarity, the Promoter shall be entitled to deal with such disputes (or any failure by Promoters to follow the rules) in their sole discretion, including that the Promoter shall be entitled to immediately disqualify Promoters from this Promotion Prize Draw

6. Participation in the Promotion constitutes acceptance of the Promotion Terms and Conditions, and Entrants agree to abide by the Promotion Terms and Conditions, in whole, and any other
requirements that the Promoter may request.

7. These Promotion Terms and Conditions constitute a bona fide binding agreement between the Promoter and the Entrant.

8. These Promotion Terms and Conditions as well as the terms of use governing Prize will apply to the Entrant’s Participation in the Promotion.

9. By entering the Promotion, the Entrant confirms that he has read, understood and agrees to be bound by these Promotion Terms and Conditions, as they may be amended from time to time.

10. Directors, members, partners, employees, agents or consultants of or any other person who directly or indirectly controls or is controlled by the Promoter or marketing service providers in respect of the Promotion Prize Draw, or the spouses, life partners, business partners or immediate family members cannot enter the Promotion. Juristic persons, or any entity other than a natural person, shall not be eligible for entry into the Promotion.

11. This Promotion will close at 23:59 on 31 December 2025 (the “Promotional Period”). Entries received after the closing date and time will not be valid and will not be considered.

12. The Promoter reserves the right, at its discretion and where reasonably necessary, to amend or adjust the dates or any aspect of the Promotion for operational reasons or due to circumstances beyond its control, provided that such amendments will not unfairly prejudice Entrants.

13. By entering the Promotion, the Entrant agrees to receive communications from the Promoter before, during and/or after the Promotion and their affiliates and shall be afforded the opportunity of unsubscribing to receiving such communications from the Promoter or its affiliates.

14. To the extent allowed by law, these Promotion Terms and Conditions and the Agreement set out the whole understanding and agreement between the Entrant and the Promoter in regard to the subject matter hereof and there are no other agreements, guarantees or representations, either verbal or in writing, unless stipulated otherwise by the Promoter, in regard thereto upon which the Entrant shall rely on in concluding this Agreement and the Promoter shall not be bound by any express or implied term, representation, warranty, promise or the like not recorded herein. This clause constitutes an acknowledgment of fact by the Entrant. The Entrant warrants that he has read the above clause carefully and ensures that this statement is true and correct as this will limit the Entrant’s rights to claim that these statements are not true and correct.

15. To the extent allowed by law, no extension of time or indulgence which the Promoter may grant the Entrant shall constitute a waiver of any of the Promoter’s rights, who shall not thereby be precluded from exercising any rights against the Entrant which may have arisen in the past or which might arise in the future. This clause limits and excludes the obligations, liabilities and legal responsibilities which the Promoter will have towards the Entrant and also limits and excludes the Entrant’s rights and remedies and places various risks, liabilities, obligations and legal responsibilities on the Entrant.

Section 2 – Warranties and Liabilities

1. To the extent allowed by law, the Entrant agrees that the Promoter shall not be liable to him or any other person or entity whatsoever in respect of any loss or damage:

1.1. caused by or arising from any fact or circumstance beyond the reasonable control of the Promoter;

1.2. which is consequential or incidental loss or damage;

1.3. of whatever nature and howsoever arising from or in connection with the Entrant’s Participation and/or acceptance of the Prize;

1.4. of whatever nature and howsoever arising out of the enjoyment of the Prize by the Entrant and/or any third party in relation;

1.5. arising from any disclosure or use of any information, or lack thereof, the Entrant provides to the Promoter, whether such disclosure is in accordance with the provisions of these Promotion Terms and Conditions or otherwise; and/or

1.6. arising from a breach of any security system which may be implemented by the Promoter and/or any service provider to the Promoter.

1.7. In the event of any dispute arising from this agreement, the dispute must be referred to the Promoter and the Promoters’ decision is final and binding.

1.8. The Promoter does not make any representation or give any warranties, whether expressly or implicitly, with regards to any Prize and, in particular, without limitation, makes no representations and gives no warranty that any Prize or any aspect of it, will –

1.8.1. meet the Promoter’s requirements, preferences, standards, or expectations; or

1.8.2. be satisfactory and readily available for collection.

1.9. The Promoter is not responsible for any injury or damage to your or any other person’s computer, mobile telephone or other device used by you to enter into, or obtain any materials related to, the Prize Draw.

1.10. The Promoter does not make any representations or give any warranties, whether expressly or implicitly, as to a Prize, and in particular, but without limitation, make no representations and give no warranty that –

1.10.1. your entry or Participation in the Prize Draw will necessarily result in you winning a Prize;

1.10.2. a Prize, or any aspect thereof, will meet your, or, if applicable, your partner’s, requirements, preferences, standards or expectations; or

1.10.3. a Prize, or any aspect thereof, will be satisfactory, punctual, free from defects, safe or reliable.

1.11. We and our affiliates will not be responsible for any harm, damage, loss or claim relating to the provision of any element of a Prize or any changes to a Prize that may be made at
any time.

1.12. The Entrants may not win a Prize if it is unlawful for us to supply such a prize to the Entrant
and we will not be liable for any liability or loss whatsoever. If the Entrant do win such a prize, the Entrant shall forfeit the Prize.

Section 3 – Indemnity

1. To the extent allowed by law, the Entrant hereby indemnifies and holds the Promoter free from liability for loss or damage of whatever nature and howsoever arising from the Entrant’s Participation and/or the Entrant’s failure to comply with any provision and/or obligation under these Promotion Terms and Conditions. This clause constitutes an assumption of risk and/or liability by the Entrant under which the Entrant indemnifies the Promoter against certain liabilities and that of which, may result in the Entrant being liable for additional costs and liabilities.

1. Entrants will be required to provide certain personal information (where applicable), including (but not limited to), their name, surname, identity number, physical address, postal address, email address and cell phone number.

2. This clause applies to all personal information collected or submitted to the Promoter as set out above as well as any other personal information provided by the Entrant to the Promoter at any
time.

3. The Promoter will use the Entrant’s personal information solely for purposes related to the administration of this Promotion, verification of eligibility, winner notification, and prize fulfilment.

4. Subject to the provisions of this Section 4, the Promoter will not share any of the Entrant’s personal information with any third party except where such disclosure is necessary to enable the Promoter to provide, deliver or in any other way give effect to these Promotion Terms and Conditions and/or the Prize, where such disclosure is required by law or where the Entrant consents to the Promoter sharing his personal information.

5. The Entrant hereby agrees to the Promoter disclosing and sharing the Entrant’s personal information with entities within the Pernod Ricard Group, including their affiliates.

6. To the extent that the Promoter shares the Entrant’s personal information with third parties in accordance with this Agreement, the Promoter will require, to the extent possible, that such parties conform to the Promoter’s privacy standards.

7. Subject to the above, the Entrant hereby expressly agrees that the Promoter may:

7.1. collect, receive, record, organize, collate, store, update, modify, retrieve, alter, consult, use, disseminate or obtain any of the personal information set out above;

7.2. use the Entrant’s personal information for the purposes set out above;

7.3. transfer the Entrant’s personal information to third parties in a foreign country where this is required for the facilitation of any transfers of information or where this is required in order to give effect to the Prize;

7.4. By participating in the Jameson Festive In-Store Promotion, the Entrant accepts that they may be asked to take part in further publicity, promotional or educational activities related to the Promotion. The Promoter may use the Winner’s name, images and other materials for brand advocacy and promotional purposes aligned with Pernod Ricard’s business, including but not limited to publication on the Promoter’s official website, X (formerly known as Twitter), Instagram, Facebook and other digital media platforms. The Winner will not be entitled to any remuneration for such participation, and all materials arising from such participation will remain the sole
property of the Promoter.

8. The Entrant may request that the Promoter correct his personal information, should it come to the Entrant’s attention that the Promoter’s records are incorrect. Should the Entrant wish to access his personal information or rectify it, the Entrant is to contact the Promoter and assistance shall be provided to this effect.

9. The Promoter shall protect the Entrant’s personal information as required by law. However, to the extent allowed by law, the Promoter shall not be liable to the Entrant or any other person or entity whatsoever, in respect of the unauthorized disclosure of the Entrant’s personal information.

10. All personal information will be processed in accordance with the Protection of Personal Information Act (POPIA). Entrants have the right to access, correct, or delete their personal data.

Section 5 – Consumer Rights

1. The Promotion Terms and Conditions and any goods and/or services provided under these Terms and Conditions will be administered in accordance with the applicable consumer protection principles and laws of the Republic of Zambia.

2. Nothing in these Terms and Conditions is intended to limit or exclude any rights or remedies to which Entrants may be entitled under Zambian consumer protection legislation.

3. To the extent that any provision of these Terms and Conditions is inconsistent with mandatory consumer protection requirements under Zambian law, such provision shall be interpreted and applied in a manner that gives effect to the Entrant’s statutory rights.

Section 6 – Promotion Entry

1. To enter, participants must:

a. Purchase a Jameson Black Barrel bottle with a promotional neck tag at participating retailers; and

b. Scan the QR code on the neck tag and follow the on-screen prompts to submit their entry.

2. Each valid entry submitted through the QR-code platform counts as one (1) valid entry.

3. Any entries submitted after 23:59 on 31 December 2025 shall not be accepted and will not be included in the Promotion.

4. On condition that the Entrant complies with the Promotion Terms and Conditions, and except insofar as provided for in applicable law, the Promoter’s decision is final, and no correspondence will be entered into.

5. If required, the Promoter reserves the right to substitute any Prize with another prize of the same or similar value.

6. Entrants and/or Winners will not be entitled to claim any royalties or intellectual property rights from the Promoter.

7. The Entrant must be over the age of eighteen (18) at the time of entering the Promotion.

8. The Entrant must be a legal resident of the Republic of Zambia at the time of entering the Promotion.

9. The Promoter may (i) refuse to award a Prize to a Winner if there is suspicion of irregularities or fraudulent activities concerning, but not limited to, entry submission or voucher redemption; or (ii) alternatively, terminate the entire Promotion.

10. The Promoter reserves the right to request—though the Entrant may decline—that images and/or videos of Winners be used for promotional or publicity purposes, without further remuneration being
payable.

11. All entries must be submitted personally by the Entrant.

12. Entries submitted on behalf of another person, or generated through automated or AI-driven means, will not be accepted.

13. Incomplete, inaccurate, illegible, corrupted, or fraudulent entries will be disqualified.

Section 7 – Prize

1. Prize

1.1. Each valid entry guarantees a prize (“the Prize”), while stocks last and only for the duration of the Promotion.

1.2. Prizes include digital vouchers issued by Webtickets and/or third-party supplied products, such as Fieldbars, as indicated on the promotional neck tag.

1.3. Prizes are provided as awarded, and do not include any additional costs or expenses incurred by the Winner.

1.4. The Promoter reserves the right to substitute the Prize or any component thereof with another of equal or similar value, without prior notice.

1.5. The Prize may not be transferred, exchanged for cash, or used in conjunction with any other offer or promotion.

2. Number of Winners

2.1. Every Entrant who submits a valid entry is eligible to receive a Prize, subject to stock availability during
the Promotional Period.

2.2. The number of Winners will correspond strictly to the number of valid entries received while promotional stock remains available.

3. Determination of Winners

3.1. Winners will be determined automatically upon successful submission of a valid entry through the QR code platform.

3.2. Digital vouchers will be delivered to Winners via email, using the contact details provided during entry

3.3. Where a Prize is fulfilled by a third-party supplier (including Fieldbars), the supplier will contact the Winner directly to arrange delivery.

3.4. The Promoter’s decision regarding eligibility and the awarding of prizes shall be final and binding, and no correspondence will be entered into.

3.5. Should the Promoter or supplier be unable to reach a Winner after three (3) attempts made within three (3) working days, the Prize will be forfeited and an alternate Winner (where applicable) will be contacted.

3.6. The same process will apply for any stand-by Winners who are contacted.

4. Additional Prize Conditions

4.1. The Prizes cannot be used in conjunction with any other promotional offer issued by the Promoter or any third party.

4.2. The Promoter retains sole discretion regarding whether to award a Prize in circumstances where
irregularities, technical errors, or suspected fraudulent activity are detected.

4.3. The Winners may be required to sign a waiver of liability and indemnity before claiming their Prize.

4.4. Winners must provide valid proof of identity (ID, passport, or driver’s licence).

4.5. Winners must be over the age of eighteen (18) at the time of receiving the Prize.

4.6. Prizes are subject to availability and may be replaced with a Prize of equal or greater value at the
Promoter’s discretion.

4.7. The Promoter is not responsible for any delays, defects, or failures related to the delivery or use of third-party Prizes.

All advertising (in-store, online, and social media) will include an age restriction warning, a responsible drinking message, and a clear reference to these T&Cs.

Section 9 – Governing Law and Jurisdiction

Governing Law and Jurisdiction

This Agreement and the Promotion shall be governed by and construed in accordance with the laws of the Republic of Zambia. The parties (including, but not limited to, the Entrants, the Promoter and any Winners)
hereby consent to the jurisdiction of the courts of the Republic of Zambia in respect of any legal proceedings arising from or related to this Agreement and/or the Promotion. Any disputes not resolved through the
Promoter’s internal processes may be referred to the appropriate Zambian consumer protection authority or other competent regulatory body.
